Australian Law Reform Commission President Cites Burford Example in Attack on Burgeoning Secondaries Market for Litigation Finance

At a recent conference put on the by the Association of Litigation Funders Australia (the Aussie version of the UK-based organization), Australian Law Reform Commission (ALRC) president Sarah Derrington derided Burford Capital’s secondary sale of 25% of its stake in the claim against the Argentinian government’s nationalization of an oil company. Derrington cited Burford’s sale as an example of “trafficking in litigation,” which she claims may be unenforceable under Australian law.
