The On the 24th of February 2020, a law stripping Cyprus citizenship was proposed and published in the official newspaper of the Republic of Cyprus. This is important because the Cyprus Investment Programme was in the spotlight a while back.

More specifically, local and international news articles announced that family members of Cambodia’s long-ruling prime minister, Hun Sen and Jho Low who was connected to 1MDB scandal in Malaysia where granted Cyprus Citizenship. 

In response, the Cyprus Ministry of Finance started an internal investigation into the investments undertaken between 1st of May 2013 and 31st of December 2018. The investigation inquired whether the investments declared to the Ministry of Finance are still held by the investors. Although the finding of that investigation has not been made available; on the 24th of February 2020, a law stipping Cyprus Citizenship was made.

Law Stripping Cyprus Citizenship

The publication is usually made in the official newspaper of the Republic of Cyprus under appendix 6.

With a surgical insertion, the legislator introduced a minor amendment to Section 113 of the Civil Registry Laws (Ν. 141(Ι)/2002) of 2002 to 2019. At Paragraph (3) immediately after the phrase “Article 111″ the following phrase was added:

“or 111A”

Explanatory Statement associated with the Law Stripping Cyprus Citizenship

In accordance with the explanatory statement accompanying the proposed law, the aim of the law stripping Cyprus Citizenship is to amend the Cyprus Civil Registry Law and allowing the Republic of Cyprus to strip the Cyprus Citizenship in cases of honorary naturalization. The justification to strip Cyprus Citizenship is for the purpose of public interest.

At the same time, the explanation goes not to provide that additional reasoning for the stripping of the Cyprus citizenship is if a citizen of the Republic of Cyprus with acts or words has internationally and unfavorably exposed the Republic of Cyprus.

Finally, the explanatory statement to the proposed law stripping the Cyprus Citizenship clarifies that the aim of this amendment is to eliminate any gaps arising from the legislation.

Meaning of ‘Internationally and Unfavorably Exposed’

Law should be clear and precise. Interpretation should be left to the courts. To a certain extent, the explanatory comments should not create a binding obligation, nevertheless, the explanatory section of several EU directives tend to be a followed.

In short, neither τhe proposed law nor the actual law comes to provide a definition of “Internationally and Unfavorably Exposed”. This absence of a strict definition or a generally accepted understanding of this term will lead the courts to interpret the cabinet of ministers’ decision.

Every other reason specified in Section 113 (see below) clearly provides the basis for which it may be invoked. In the instance of the proposed law, though no reasoning is given in the actual law and in the explanation, the justification is weak and unclear.

The result, as I understand it, is excess power in the hands of the cabinet of ministers to bluntly and unilaterally decide who and under what conditions may get to keep the Cyprus Citizenship which he has so costly acquired. 

On the one hand, the proposed law stripping the Cyprus citizenship can create swiftness and resolve for the cabinet of ministers but ultimately it is a double-edged sword.

Naturalized Cyprus Citizens require CERTAINTY

The certainty that the investment projects will be delivered is as equally important to keeping the Cypriot Nationality.

The absence of fundamental justification for stripping the Cyprus citizenship will affect the trustworthiness of Cyprus.

Greek Translation of Section 113 of the Civil Registry Law

Στέρηση της ιδιότητας του πολίτη

113.—(1) Πολίτης της Δημοκρατίας ο οποίος είναι πολίτης σύμφωνα με εγγραφή ή είναι πολιτογραφημένο πρόσωπο, παύει να είναι πολίτης της Δημοκρατίας εάν στερηθεί της ιδιότητας του πολίτη με διάταγμα του Υπουργικού Συμβουλίου που εκδίδεται σύμφωνα με το άρθρο αυτό.

(2) Τηρουμένων των διατάξεων του άρθρου αυτού το Υπουργικό Συμβούλιο μπορεί με Διάταγμα να στερήσει οποιοδήποτε τέτοιο πολίτη από την ιδιότητα του πολίτη της Δημοκρατίας εάν ικανοποιηθεί ότι η εγγραφή ή το πιστοποιητικό πολιτογράφησης αποκτήθηκε με δόλο, ψευδείς παραστάσεις ή απόκρυψη οποιουδήποτε ουσιώδους γεγονότος.

(3) Τηρουμένων των διατάξεων του άρθρου αυτού το Υπουργικό Συμβούλιο μπορεί με Διάταγμα να στερήσει από οποιοδήποτε πολίτη της Δημοκρατίας, το οποίο είναι πολιτογραφημένο δυνάμει των διατάξεων του άρθρου 111 ή εγγεγραμμένο πρόσωπο δυνάμει των διατάξεων του εδαφίου (2) του άρθρου 110 πρόσωπο, την ιδιότητα του πολίτη εάν ικανοποιηθεί ότι ο πολίτης αυτός-

(α) Μέ έργα ή με λόγια επέδειξε, έλλειψη νομιμοφροσύνης ή δυσμένεια στη Δημοκρατία, ή

(β) σε οποιοδήποτε πόλεμο που διεξάγεται από τη Δημοκρατία παράνομα επιδόθηκε σε συναλλαγή ή επικοινώνησε με τον εχθρό ή επιδόθηκε στη διεξαγωγή ή συμμετείχε σε οποιαδήποτε επιχείρηση η οποία σε γνώση του διεξαγόταν κατά τέτοιο τρόπο ώστε να βοηθήσει τον εχθρό κατά τον πόλεμο αυτό, ή

(γ) μέσα σε δέκα (10) χρόνια από την εγγραφή ή πολιτογράφησή του καταδικάστηκε σε οποιαδήποτε χώρα σε φυλάκιση για ιδιαιτέρως ειδεχθές αδίκημα ή για αδίκημα που ενέχει ηθική αισχρότητα, νοουμένου ότι η εν λόγω καταδίκη αφορά αδίκημα το οποίο αποτελεί και στη Δημοκρατία αδίκημα το οποίο είναι ιδιαιτέρως ειδεχθές ή ενέχει ηθική αισχρότητα και το οποίο επισύρει ποινή φυλάκισης.

(4) Το Υπουργικό Συμβούλιο μπορεί με Διάταγμα να στερήσει οποιονδήποτε πολίτη της Δημοκρατίας, το οποίο είναι πολιτογραφημένο πρόσωπο, την ιδιότητα του ως πολίτη εάν ικανοποιηθεί ότι το πρόσωπο αυτό διέμενε συνήθως σε ξένες χώρες για συνεχόμενο χρονικό διάστημα επτά ετών και εάν κατά τη διάρκεια του διαστήματος αυτού δεν-

(α) Διετέλεσε καθ’ οιονδήποτε χρόνο στην υπηρεσία της Δημοκρατίας ή Διεθνούς Οργανισμού του οποίου η Δημοκρατία είναι μέλος, ή

(β) γνωστοποιούσε κάθε χρόνο, κατά τον καθορισμένο τρόπο, σε Προξενείο της Δημοκρατίας την πρόθεσή του να διατηρήσει την ιδιότητά του ως πολίτη της Δημοκρατίας.

(5) Το Υπουργικό Συμβούλιο δεν αποστερεί οποιοδήποτε πρόσωπο από την ιδιότητά του ως πολίτη σύμφωνα με το άρθρο αυτό εκτός εάν ικανοποιηθεί ότι δε συντελεί στο δημόσιο συμφέρον όπως το πρόσωπο αυτό εξακολουθήσει να είναι πολίτης της Δημοκρατίας.

(6) Προτού εκδώσει Διάταγμα σύμφωνα με το άρθρο αυτό, το Υπουργικό Συμβούλιο δίδει στο πρόσωπο, κατά του οποίου πρόκειται να εκδοθεί τέτοιο Διάταγμα, γραπτή ειδοποίηση με την οποία το πληροφορεί για το λόγο με βάση τον οποίο πρόκειται να εκδοθεί το εν λόγω Διάταγμα. Εάν το Διάταγμα αυτό πρόκειται να εκδοθεί με βάση οποιουσδήποτε από τους καθορισμένους στα εδάφια (2) και (3) του άρθρου αυτού λόγους, το επηρεαζόμενο πρόσωπο ενημερώνεται ειδικά για το δικαίωμα που παρέχεται σ’ αυτό για να ζητήσει τη διεξαγωγή έρευνας, σύμφωνα με το άρθρο αυτό.

(7) Εάν το Διάταγμα πρόκειται να εκδοθεί με βάση οποιουσδήποτε από τους καθορισμένους στα εδάφια (2) και (3) λόγους και το επηρεαζόμενο πρόσωπο ζητά τη διεξαγωγή έρευνας, το Υπουργικό Συμβούλιο δύναται να παραπέμψει την υπόθεση αυτή στην Επιτροπή Έρευνας, που διορίζεται ειδικά για το σκοπό αυτό από το Υπουργικό Συμβούλιο. Η Επιτροπή Έρευνας αποτελείται από τον Πρόεδρο, που έχει αποκτήσει δικαστική πείρα, και τέτοιο αριθμό μελών όπως το Υπουργικό Συμβούλιο κρίνει αναγκαίο.

English Translation of Section 113 of the Civil Registry Law

Deprivation of citizenship
113 .— (1) A citizen of the Republic who is a citizen by registration or is a naturalized person ceases to be a citizen of the Republic Republic if he is deprived of his citizenship by a decree of the Council of Ministers issued in accordance with this article.

(2) Subject to the provisions of this article, the Council of Ministers may by decree deprive any such citizen of his capacity as a citizen of the Republic if satisfied that the registration or the naturalization certificate has been obtained by fraud, false representations or concealment of any material fact.

(3) Subject to the provisions of this Article, the Council of Ministers may by decree deprive any citizen of the Republic who is naturalized under the provisions of Article 111 [or 111A (new provision)] or a person registered under the provisions of Article 110 (2), citizenship if it is satisfied that this citizen-

(a) By works or in words, he has shown dishonesty or malice in the Republic, or

(b) in any war conducted by the Republic illegally engaged in a transaction or communicated with the enemy or engaged in or engaged in any operation which was carried out in his knowledge to assist the enemy in that war; or

(c) within ten (10) years of his registration or naturalization, he has been sentenced in any country to imprisonment for a particularly heinous crime or for an offense involving moral obscenity provided that the conviction in question is an offense which constitutes an offense in the Republic as well. who is particularly heinous or has a moral obscenity and who carries a prison sentence.

(4) The Council of Ministers may by decree deprive any citizen of the Republic, who is a naturalized person, of his status as a citizen if he is satisfied that this person has habitually resided in foreign countries for a continuous period of seven years and if during that time-

(a) Has served at any time in the service of the Republic or of an International Organization of which the Republic is a member; or

(b) annually notified the Consulate of the Republic, in the manner specified, of its intention to retain its status as a citizen of the Republic.

(5) The Council of Ministers shall not deprive any person of his capacity as a citizen in accordance with this Article unless it is satisfied that it does not serve the public interest as such person continues to be a citizen of the Republic.

(6) Before issuing a decree in accordance with this Article, the Council of Ministers shall give the person against whom such a decree is to be issued a written notice informing him of the reason on the basis of which the decree is to be issued. If this Decree is to be adopted on the basis of any of the grounds set forth in subparagraph (2) and (3) of this Article, the person concerned shall be specifically informed of the right conferred on it to request an investigation, in accordance with this article.

(7) If the Decree is to be adopted on the basis of any of the grounds set out in subsections (2) and (3) and the person concerned requests an investigation, the Council of Ministers may refer this case to the Committee of Inquiry specifically appointed. for this purpose by the Council of Ministers. The Inquiry Committee is composed of the President, who has acquired judicial experience, and such a number of members as the Council of Ministers deems necessary.
