David F. Johnson presented his paper on “Remedies for Breach of Fiduciary Duty Claims” to the Tarrant County Probate Bar Association’s Litigation Seminar on August 7, 2020. This presentation covered pre-trial remedies such as injunctions, receiverships, and audits and also covered post-trial remedies such as direct damages, lost profits, consequential damages, mental anguish, pre-judgment interest, attorney’s fees, punitive damages, fee forfeiture, profit disgorgement, contractual consideration forfeiture, declaratory relief, rescission, constructive trust, equitable liens, and partition.
