On 7 January 2021, the United States’ Commodity Futures Trading Commission (CFTC) and the European Securities and Markets Authority (ESMA) announced that they had signed a new Memorandum of Understanding (MoU) regarding cooperation and exchange of information with respect to certain registered derivatives clearing organisations established in the United States that are central counterparties (CCPs) recognised by ESMA under the European Market Infrastructure Regulation. Through the MoU, ESMA and the CFTC express their desire for enhanced cooperation as to the larger United States’ CCPs operating in the EU with provisions that expand upon the collaboration set out in the 2016 CFTC-ESMA MoU related to recognised CCPs.
