Ag-Gag Statutes: Tenth Circuit Affirms Unconstitutionality of Kansas’s Ag-Gag Law
On August 19, 2021, the U.S. Court of Appeals for the Tenth Circuit issued an opinion affirming the district court’s injunction barring enforcement of key provisions of the Kansas Farm Animal and Field Crop and Research Facilities Protection Act (Act). Animal Legal Defense Fund, et al v. Kelly, et al, No. 20-3082; Animal Legal Defense Fund v. Kelly, No. 2:18-cv-02657 (D. Kan.).  Sections (b), (c), and (d) of the Act criminalize “exercising control over,” recording on, and trespassing onto an animal facility “without effective consent of the owner and with the intent to damage the enterprise” (K.S.A. § 47-1827).  Kansas challenged the lower court’s finding of unconstitutionality, arguing: (a) that the statute only prohibits conduct; (b) that it targets only false speech, which it argues is unprotected, and (c) the statute is “content and viewpoint-neutral.”  The court rejected Kansas’s arguments, finding the statute’s “intent” provision too broad because it “does not delineate protected from unprotected speech.”  Additionally, the court found that the damage the statute seeks to prevent, “negative publicity, lost business, or boycotts,” was too attenuated from any deception used to enter the facility and could derive from “true speech on a matter of public concern.”  See ALWR—April 9, 2020, “Kansas Ag Protection Law Provisions Permanently Enjoined” and ALWR—January 30, 2020, “Federal Court Strikes Down Kansas Agricultural Protection Law.”

COVID-19: USDA Announces $400 Million Dairy Donation Program Details
On August 25, 2021, the U.S. Department of Agriculture’s (USDA) Agricultural Marketing Service (AMS) announced the upcoming Federal Register publication of a draft interim rule providing details of the $400 million Dairy Donation Program (DDP).  Under the program, dairy cooperatives and processors who partner with the charitable food system for milk and dairy product donations or discounting may apply for processing, transportation, and other cost reimbursements.  Due to the availability of reimbursement, tax deductibility of any amounts are uncertain.  The rule will become effective one day after publication and will expire within two years unless extended.

COVID-19: USDA Amends Contract and Specialty Crop Producer CFAP 2 Loss Calculation
On August 24, 2021, the U.S. Department of Agriculture’s (USDA) Farm Service Agency (FSA) announced changes to the Coronavirus Food Assistance Program 2 (CFAP 2) program, which is funded with $1 billion from the Consolidated Appropriations Act of 2021. Under CFAP 2, contract poultry, egg and livestock producers, and producers of “sales-based commodities” (mostly specialty crops) may modify existing or file new applications by October 12, 2021, using either 2018 or 2019 in measuring 2020 lost revenue.  The changes were formally published as a Final Rule at 86 FR 48013 on August 27, 2021, the rule’s effective date.

COVID-19: USDA Announces $300 Million Funding and Strategic Framework for SARS-CoV-2, Zoonotic Disease Surveillance
On August 24, 2021, the U.S. Department of Agriculture (USDA) announced that it will dedicate $300 million in American Rescue Plan Act funding to support animal-based SARS-CoV-2 and other emerging zoonotic disease surveillance and for implementation of a zoonotic disease early warning system.  Additionally, USDA’s Animal and Plant Health Inspection Service (APHIS) published its Strategic Framework for conducting surveillance in susceptible animals.  Under the framework, APHIS will survey a wide variety of animal species, including farmed animals, wildlife, peridomestic species, and companion animals and focus on disease detection through partnerships with government and industry entities.  USDA will host a  webinar series (August 31, September 1, September 8, and September 15, 2021) for interested stakeholders before submitting public comments on the framework by the October 8, 2021 deadline.

Packers and Stockyards Act: USDA Publishes FAQ on “Undue and Unreasonable Preference or Advantage”
On August 24, 2021, the U.S. Department of Agriculture’s (USDA) Agricultural Marketing Service (AMS) published guidance on its website titled, “Frequently Asked Questions [FAQ] on the Enforcement of Undue and Unreasonable Preferences under the Packers and Stockyards Act (P&S Act).”  AMS states that, although the agency intends to promulgate three P&S Act rulemakings, the December 2020 rule on “Undue and Unreasonable Preferences and Advantages” (85 FR 79779; 9 CFR §201.211) remains effective until the agency completes the new rules.  Under the existing rule, when determining whether packer and/or dealer conduct establishes an “undue or unreasonable preference or advantage,” USDA will consider whether the preference or advantage is unjustifiable: (1) based on cost savings from “dealing with different producers;” (2) based on meeting competitor prices; (3) based on meeting a competitor’s “other terms;” and (4) “as a reasonable business decision.”  The FAQ provides several examples of situations that might establish an undue or unreasonable preference or advantage, depending on the exact facts.

Biotechnology: USDA-APHIS Announces Draft Regulatory Status Review Guidance for Genetically Engineered Plants
On August 25, 2021, the U.S. Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS) announced the publication of draft guidance for requesting a Regulatory Status Review (RSR) of genetically engineered plants.  According to the guidance, APHIS will follow a two-step process upon receiving a RSR request: 1) conduct an initial review within 180 days to determine whether the plant poses an increased plant pest risk, and 2) upon finding that a plant poses an increased plant pest risk, inform the requestor of the increased risk, who may then choose to request that APHIS assess the risk, pause the RSR process, or withdraw the RSR request.  The guidance has a 60-day public comment period that closes October 25, 2021.  APHIS will host a webinar on the RSR guidance and process on September 21, 2021, at 3:00 p.m.

Dairy Policy: Pennsylvania Milk Marketing Board Enters Consent Order Against Upstate Niagara Cooperative for TEFAP Fluid Milk Sales Below Pennsylvania Minimum Wholesale Price
On August 11, 2021, the Pennsylvania Milk Marketing Board (PMMB) voted to accept a proposed consent order with Upstate Niagara Cooperative (Upstate) acknowledging Upstate’s below Pennsylvania minimum price sales from its northern Pennsylvania plant, formerly Schneider Valley Farms, in violation of Pennsylvania’s Milk Marketing Law and consenting to Upstate’s citation settlement payment of $36,240.  In May 2021, Upstate was awarded USDA contracts to supply fluid milk for The Emergency Food Assistance Program (TEFAP) based on bids below PMMB minimum prices.  According to PMMB’s Sunshine Meeting minutes, PMMB will continue monitoring bid solicitations for compliance. On August 23, 2021, PMMB Secretary Carol Hardbarger published an account of the incident and other related facts and comments in Lancaster Farming.

Dairy Policy: Danone Terminates Horizon Organic Producers
On August 25, 2021, Maine’s Governor Janet Mills and its Department of Agriculture, Conservation, & Forestry (DACF) announced that it is researching ways to assist fourteen Maine organic dairy producers that received termination letters from Danone, owner of Horizon Organic, effective August 2022.  According to the announcement, Danone has also terminated an unspecified number of producers in New Hampshire, Vermont, and New York.  Unconfirmed additional information, including alleged statements of Danone with regard to its actions taken regarding 89 existing dairy producers in multiple New England states, can be read here on the website of an organization called Northeast Organic Dairy Producers Alliance.  Caution is advised regarding this information unless confirmed by a primary source such as Danone or a government agency.
