Can a Prenuptial Agreement stand valid for an Indian in relationship with a UK citizen?

  • Prenup agreements are not legally tenable in India, as the law does not consider marriage as a contract.
  • However, an Indian who is in a relationship with a UK citizen (British National or ‘Settled’ ILR Status) can get a prenup as the UK Laws recognize this agreement.
  • A Prenuptial Agreement will ONLY stand valid and legal, if both parties sign and notarize the agreement, enter into the agreement with free will and is fair.
  • Essentially, a prenup is signed before marriage. A situation where a couple is already married but still wants some monetary protection, they can have a Postnuptial Agreement instead. This has the same legal treatment as a prenuptial agreement – the only difference is the timing of it.
  • In case of a divorce, the Indian citizen married to a British MUST inform the Home Office stating all the details and further apply freshly for a new category of visa (after checking for eligibility).
  • At the time of Court proceedings, you can claim Home Rights (after registering with The Land Registry) and claim maintenance (financial support) if you have children with your partner. The Court will also declare the responsibilities of debts (if any) on the name of the partner who is accountable for that amount.
