Background Information on the Philips CPAP Lawsuit

Several people are taking legal action against Philips regarding their CPAP ventilator. The central premise of the case is that the polyester-based polyurethane (PE-PUR) sound abatement foam in the sleep apnea machine may be responsible for people experiencing severe respiratory issues and cancer. 

People filing the lawsuits actively ask for compensation, claiming that Philips manufactured the CPAP with defects, had knowledge about it, and didn’t warn the public of the risks. Unfortunately, the evidence does not stop there. The FDA’s investigation uncovered disturbing evidence that Philips had already conducted their own internal investigation and was aware of the potentially carcinogenic foam in the CPAP machine. The FDA showed that Philips continued to use the foam without alerting the public of its risks. 

CPAP Recalled

In June 2021, Philips recalled the CPAP ventilator, among other similar devices. Their statement on the PE-PUR foam claimed that there could be a potential release of harmful black particles and toxic gasses which people can inhale or swallow. The CPAP recall impacted millions of CPAP or similar machine users who had to seek other sleep apnea machines. 

Initially, the CPAP manufacturers stated that they would fix any issues regarding the CPAP foam use and replace any CPAP machines for users. In November 2021, the FDA found that the new foam used in the replacement CPAPs could also be potentially harmful. The FDA concluded by stating that Philips has known since 2015 that PE-PUR foam could pose a health risk for its users. 

Philips’ Response to Lawsuits

Philips’ response was to admit that there was a risk of foam degradation but attributed it to ozone cleaning machines for the CPAP ventilator, such as those made by SoClean Inc. SoClean responded by suing Philips for blaming the company citing the FDA report in its lawsuit. Interestingly, that lawsuit contained evidence that Philips had known for years that the PE-PUR foam was a health hazard. Instead of warning people and redeeming the situation, they ran a smear campaign against SoClean Inc. 

Although more evidence came to light regarding the PE-PUR foam degradation, Philips maintained the same stance of accusing ozone CPAP cleaners. They claim that when the foam is exposed to ozone cleaners, its degradation likelihood increases by at least 14 times. They also claim that the foam is not expected to cause any health issues if it does not come into contact with ozone cleaning machines. 

Health Hazards Attributed to Defective CPAP Ventilator

The degraded PE-PUR foam in these ventilators is named in the Philips lawsuits as causing organ damage and cancer. Specifically, CPAP users have complained to Philips about headaches, airway problems, chest pressure, infections in the upper respiratory system, and other health hazards that may cause permanent damage or even be fatal.  

The injuries mentioned in the Philips lawsuits include a substantial number of organ damages (including kidney, liver, and lung) and an alarming rate of cancers (such as bladder, brain, breast, kidney, liver, lung, lymphatic, prostate, rectal, stomach, testicular, and thyroid). 

The FDA has amassed nearly 21,000 reports claiming that individuals sustained injuries due to the defective CPAP machine, 124 of which have been fatal.
