Recent UK Visa news

The UK Home Office has recently announced new UK Visa news with several adjustments to some UK immigration routes as well as the establishment of two new immigration routes in its most recent Statement of Changes to the Immigration Rules (HC719), which was released on 18 October 2022. We’ve highlighted some significant updates to the immigration laws that potential applicants should be aware of in this post, including:

  • The opening of a new immigration route for workers in the poultry industry;
  • The creation of a new Appendix for victims of slavery or human trafficking called Temporary Permission to Stay;
  • Removal of the police registration programme;
  • Granting citizens of Colombia, Guyana, and Peru non-visa national status; and
  • An expansion of the adult children’s Hong Kong BN(O) Household Member Route

1. A new pathway to immigration for Poultry Workers

A major UK Visa news is for Poultry workers. For the period from 18 October to 31 December every year, the Temporary Work-Seasonal Worker Visa has been expanded to include a variety of positions in the poultry industry. The goal of this is to promote the poultry industry during the peak holiday shopping season.

The new rules went into effect on October 18, 2022, at 1600.

Anyone desiring to work in one of the following positions is eligible for the new poultry production worker route of the seasonal worker visa: Butcher, Bird/game dresser, Killer and plucker, Plucker, Poulterer, a Poultry processor, Poultry sticker, Trusser, Food worker, Poultry catcher/handler, Poultry vaccinator, or Poultry meat packer are some other terms for these professionals.

2. New Appendix: Temporary Stay Permits for Slave or Human Trafficking Victims

A new Appendix Temporary Permission to Stay for Victims of Human Trafficking or Slavery establishes a pathway for someone who has been positively identified as a victim of human trafficking or slavery, who is not a British citizen, and who is currently in the UK without authorization to remain, to be taken into consideration for staying. The service will begin on January 30, 2023.

An applicant must submit form FLR (HRO) and demonstrate to UK Visas & Immigration that they meet the following criteria to be granted permission to remain as a victim of human trafficking or slavery:

A favourable conclusive grounds decision (as outlined in section 69 (1) of the Nationality and Borders Act 2022) has been served to them;
They don’t hold British citizenship;
They are not already authorised to remain in the UK under another category;
Located in the UK;
They have permission to remain as a victim of human trafficking or slavery, or as the child of a victim of human trafficking or slavery, or they have modern slavery discretionary leave as a victim of human trafficking or slavery, or as their child dependents, if they are applying for an extension through this route.

A victim of human trafficking or slavery, or a dependant child of a victim of human trafficking or slavery, may be given temporary authorization to remain for a period not to exceed 30 months per grant.

3. The Police Registration Scheme is repealed

In August of this year, the government of the UK decided to terminate the Police Registration Scheme with immediate effect, as we previously reported. This meant that the requirement for foreign nationals to register with the police upon arrival in the UK or obtain additional leave to remain was suspended. Foreign nationals of specified nationalities, aged 16 or over, who are typically granted more than six months’ leave under certain migration categories, were exempt from this requirement.

The current Statement of Changes’ Explanatory Memorandum clarifies additional details about the suspension’s causes:

The Home Office now electronically captures the same information gathered by the police during the visa application process. More people are being screened before they go to the UK as a result of changes made to the Immigration Rules and the larger immigration system since the scheme was first implemented, allowing the Home Office to identify those who are of concern earlier in their interactions with them. Therefore, gathering the same information once a person has arrived in the UK is not really necessary for the police.

4. Peruvian, Guyanan, and Colombian nationals now have visa-free status

The people of Colombia, Guyana, and Peru will no longer require visas as of November 9, 2022.

Without needing to first get a visit visa, a non-visa national can typically apply for entry as a Visitor upon arrival in the UK.

Notably, non-visa foreigners are still subjected to an immigration officer’s inspection upon arrival and need to obtain authorisation in order to enter the UK.

5. Route for Household Members of Hong Kong BN(O) Expanded for Adult Children

For adult children (aged 18 or over) of BN(O) Status Holders or BN(O) Status Holders’ partners who were born on or after 1 July 1997 to live, work, and study in the UK, there is the Hong Kong BN(O) Household Member Visa.

The government announced in February 2022 that the BN(O) Household Member route would be expanded to allow adult children of BN(O) Status Holders who were born on or after 1 July 1997 to apply separately from their BN(O) Status Holder parents (i.e., without having to live in the same household as them or submit an application at the same time).
