Here is a backstory of the client’s situation…

The client’s mother is a healthcare worker in the UK, but her family continued to reside in India. When the applicant’s mother was eventually granted ILR status (Permanent Residence) after 5 years in the UK, our client, too, was granted a UK ILR for being a “dependent child of a Settled person” in the UK. Upon receiving her medical degree, the client returned to India and started her practice.

The case…

The applicant would travel to the UK to visit her mother, however because of COVID-19, she could not visit the UK. The lockdowns and the travel bans in both countries made it impossible for her to get out of India. She had to stay back in India with her father and could not go back to the UK for more than 2 years. Since she was away from the UK for over 2 years, her ILR was revoked by the Home Office.

According to UK immigration laws, if a person with an ILR status leaves the country and does not return to the UK for two years, the ILR then stands invalid.
