Food Labeling: Multidistrict Litigation Panel Consolidates Beyond Meat False Advertising Cases
On February 1, 2023, the U.S. Judicial Panel on Multidistrict Litigation issued a transfer order consolidating in the U.S. District Court for the Northern District of Illinois five cases alleging false advertising claims against Beyond Meat, Inc., which manufactures plant-based meat substitute products. In RE: Beyond Meat, Inc., Protein Content Marketing and Sales Practices Litigation, No. 1:23-cv-00669. According to the transfer order, the plaintiffs claim that Beyond Meat “(1) miscalculates and overstates its products’ protein content; (2) miscalculates and overstates the quality of the products’ protein, which is represented as a percentage of daily value; and (3) misleads consumers into believing that the products provide the same nutritional benefits as traditional meat products.” The consolidated cases are

  • Roberts v. Beyond Meat, Inc., No. 1:22-cv-02861 (N.D. Ill., filed May 31, 2022),
  • Cascio v. Beyond Meat, Inc., No. 2:22-cv-04018 (E.D. NY, filed July 8, 2022),
  • Miller v. Beyond Meat, Inc., No. 1:22-cv-06336 (S.D. NY, filed July 26, 2022),
  • Garcia v. Beyond Meat, Inc., No. 4:22-cv-00297 (S.D. Iowa, filed Sept. 9, 2022),
  • Borovoy v. Beyond Meat, Inc., No. 1:22-cv-06302 (N.D. Ill., filed Nov. 9, 2022).

Agricultural Labor: OSHA Fines Beef Processor for Exposing Workers to Unsafe Carbon Dioxide Levels
On February 3, 2023, the U.S. Department of Labor (DOL) Occupation Safety and Health Administration (OSHA) issued a citation fining beef processor Republic Foods, ZMDR LLC (Republic) $573,913 for exposing its employees to unsafe levels of carbon dioxide, which is released from dry ice used in the packing process. According to the citation, Republic exposed its employees to carbon dioxide levels ranging from 7,100 to 10,000 parts per million, above the standard 5,000 parts per million. Also announced by OSHA, the citation was Republic’s seventh violation for unsafe carbon dioxide exposure since March 2020. Republic has 15 days to comply with the citation, request a meeting with OSHA’s area director, or contest the findings.

Food Safety: Breakfast Cereal Manufacturer Pleads Guilty to Distributing Adulterated Food, Will Pay $19 Million Fine
On February 3, 2023, the U.S. Department of Justice (DOJ) announced that food and ingredient manufacturing company Kerry Inc. pleaded guilty to charges of manufacturing products under insanitary conditions and agreed to pay criminal fines totaling $19.2 million. In December 2022, DOL filed charges against Kerry for selling adulterated foods after discovering insanitary conditions at a facility in Gridley, Illinois, which manufactured Honey Smacks breakfast cereal linked to a 2018 salmonella poising outbreak. United States v. Kerry, Inc., C.D. Illinois, No: 22-10051. Under the plea agreement, Kerry pleaded guilty to a misdemeanor count of distributing adulterated cereal in violation of the Food, Drug, and Cosmetic Act and failing to implement corrective and preventative actions to mitigate salmonella exposure. The agreement is still subject to judicial approval before becoming effective.

Avian Influenza: National Chicken Council Petitions FDA to Allow Sale of Surplus Eggs to Lower Egg Prices
On February 9, 2022, the National Chicken Council (NCC) petitioned the Food and Drug Administration (FDA) to allow surplus eggs produced by broiler chickens to be sold to “egg breakers” for use as ingredients in manufactured food products rather than retailed as shell eggs.  Current regulations require eggs used by breakers to be kept at 45°F within 36 hours after being laid, but broiler chicken producers generally keep laid eggs at 65°F. The NCC claims surplus eggs stored at 65°F are safe for breaker use due to pasteurization efficiency and anticipates that utilization of surplus eggs will help lower shell egg prices during supply shortages caused by highly pathogenic avian influenza (HPAI).

Conservation Programs: Consolidated Appropriations Act Authorizes USDA Carbon Credit Market Oversight
On December 29, 2022, when President Biden signed into law the 2023 Consolidated Appropriations Act (H.R.2617), the law contained carbon credit provisions from the Growing Climate Solutions Act (S.1251)—which the Senate passed by a 92-8 vote in 2021 but was never brought up for a vote in the House of Representatives. As a result, the U.S. Department of Agriculture (USDA) is now authorized to create the “Greenhouse Gas Technical Assistance Provider and Third-Party Verifier Program” to provide a regulatory framework for contractual production and sale of carbon credits by agricultural operations for re-sale through private markets. A summary of the law’s provisions has been authored by Peggy Kirk Hall, Assoc. Professor, Agricultural & Resource Law, Ohio State University Extension, titled Carbon Credit Market Assistance Program Now in the Hands of USDA.

Agricultural Finance: USDA Simplifies Direct Loan Applications
On February 7, 2023, the U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) announced a simplified direct loan application. This simplified application is 13 pages long—compared to the previous 29-page application—and can be filed electronically or in person at an FSA farm loan office. FSA anticipates this simplified application, paired with the Loan Assistance Tool released in October 2022, will decrease the number of incomplete applications unfiled due to the application’s length and complexity. The simplified application will be available beginning March 1, 2023. 

Conservation Programs: USDA Announces Strategies to Conserve Water in Western United States
On February 13, 2023, the U.S. Department of Agriculture (USDA) announced the Western Water and Working Lands Framework for Conservation Action (WWWLF) and the WaterSMART Initiative, new strategies to address water supplies in western states. USDA’s Natural Resources Conservation Service (NRCS) will administer both strategies, which were partially funded by the Inflation Reduction Act to help to conserve water, combat climate change, and improve drought resiliency in western states. The WWWLF will implement 13 key strategies in 17 western states and the WaterSMART Initiative will invest $25 million in three new priority areas and 37 existing priority areas to assist western states.

Conservation Programs: USDA Announces More Conservation Program Funding
On February 13, 2023, the U.S. Department of Agriculture announced that it is making available $850 million of the $19.5 billion appropriated by the Inflation Reduction Act for climate-smart initiatives in the following Natural Resources Conservation Service (NRCS) conservation programs which provide payments to agricultural or forest landowners who engage in voluntary conservation programs and adopt defined climate-smart practices:

The NRCS accepts applications to its programs year-round, but those interested in the EQIP or CSP should apply by their state’s ranking dates. Applications for ACEP or Wetland Reserve Easements must be submitted by March 17, 2023. The NRCS plans to roll out funding for the RCPP in the early spring.

Water Quality: Maryland Issues Valley Proteins New NPDES Permit, Effective Through January 2028
On February 1, 2023, Valley Proteins Inc.’s National Pollutant Discharge Elimination System (NPDES) permit became effective, good through January 31, 2028. The Maryland Department of Environment (MDE) recently issued the permit on December 27, 2022, after a final permit review. The permit lets the Linkwood, Maryland-based poultry rendering company discharge an annual average of 150,000 gallons per day of wastewater and allows for an increase up to 575,000 gallons per day. Valley Protein’s new NPDES permit follows the company’s numerous NPDES permit violations and September 2022 consent decree with MDE requiring it to pay $540,000 in civil penalties.  See Valley Protein Enters into Consent Decree for NPDES Violations, ALWR—Oct. 7, 2022.
