On Tuesday, the U.S. 6th Circuit Court of Appeals heard oral arguments (audio of full oral arguments) in Doe No. 1 v. Bethel Local Board of Education, (6th Cir., Docket No. 23-3740). In the case, an Ohio federal district court (see prior posting) dismissed a wide-ranging group of challenges– including due process, equal protection and free exercise challenges– to a school board policy allowing students to use school bathrooms corresponding to their gender identity.
