Napoli Shkolnik has filed a complaint toward The Mount Sinai Hospital on behalf of a newborn infant, Noah Morton, who died at Mount Sinai hospital during the nurse’s strike in early January 2023.
Summary of Case
The baby, Noah Morton, had spent his entire short life in the ICU with a heart condition. Despite believing their son was improving and would soon be coming home, Noah’s parents received a call on January 11 that their son had died.
Noah’s parents were told by a staff member at the hospital their son had died during a medical procedure. They received no further information as to his death from Mt. Sinai Hospital other than it was due to “natural causes.”
However, during the time around Noah’s death, nurses at the hospital, including NICU nurses, were on strike. The basis for this strike, among other things, was staffing shortages and unsafe conditions at the hospital.
Noah was left in the understaffed and unprepared Mt. Sinai NICU, where Mt. Sinai had replaced striking nurses with nurses who had little or no NICU experience.
“The death of Noah Morton was preventable and due to the failures of Mt. Sinai Hospital to properly plan, staff, and care for their patients, such as NICU babies, during the strike,” said Napoli Shkolnik Partner Joseph L. Ciaccio.
