The U.S. Supreme Court hears oral arguments this morning in Kennedy v. Braidwood Management, Inc. Plaintiffs in the case objected on religious grounds to providing their employees the U.S. Preventive Services Task Force’s mandated insurance coverage for pre-exposure drugs that prevent the transmission of HIV. Plaintiffs contended that this coverage makes them complicit in facilitating homosexual behavior, drug use and sexual activity outside of marriage. In the case, the U.S. 5th Circuit Court of Appeals held that the structure of the U.S. Preventive Services Task Force violates the Appointments Clause of the U.S. Constitution.
