The FCC has adopted a Report and Order that eliminates the requirement for broadband providers to have their Broadband Data Collection (BDC) filings certified by a licensed professional engineer or corporate engineering officer.  Instead, consistent with previously issued waivers, providers may now use a “qualified engineer” with relevant education and experience, to certify the accuracy of their submitted data.  The elimination of this requirement addresses concerns from some in the industry concerning the limited availability and high cost of licensed engineers.

The Commission maintains the requirement for a corporate officer to certify the submitted data, as consistent with the Broadband DATA Act, in addition to a certification by a “qualified engineer.”  The FCC determined that this approach preserves data accuracy while reducing regulatory burdens for smaller providers.  This rule will take effect immediately upon publication in the Federal Register.
