In order to be able to bring the personal injury claim in Arizona, you have to prove that the other party was negligent. What exactly is “negligence“? The law prescribes a legal standard for everyone, and this standard is always based upon the “reasonable person standard“. Stated more simply, negligence is doing something that you should not have done, or perhaps, not doing something that you should have done. Always ask yourself:  In…
Saturday, July 4th was the 244th celebration of the day the United States declared our independence from England.  In Independence Hall in Philadelphia, our forefathers came together, led by Thomas Jefferson, to pen that one-page famous document known ever since as “The Declaration of Independence”.  Have you ever actually read the Declaration? Do you know what it says?  It is fascinating.  I’ll abbreviate part of it here for you: “When in the course of human…
48 years is a long time!  It seems even longer when you consider the last time Arizona updated its auto insurance requirements was in June of 1972.  Richard Nixon was President and Jack Williams was the Governor of Arizona. (Don’t worry we had to look that up too!)  Beginning July 1, 2020, a new Arizona law will require insurance policies to provide minimum coverage of $25,000 per person, $50,000 per accident, and $15,000 in property…

Why it’s important to hire a personal injury lawyer that solely focuses on personal injury matters as opposed to a firm that practices many areas of law. If you are the victim of a personal injury incident or accident, you need to find the right attorney to help you in your case. There seem to be so many, so how do you choose? It is extremely important that you find an attorney whose practice is…
Accepting insurance money for an accident will make your recovery “final.” In other words, you will not be able to get “more” money or file a lawsuit once you have settled your case. As such, it is important that all legal considerations are taking into account before this “final” act. Without the years of experience, training, and education of working with insurance companies, taking cases to jury trials, and winning “unwinnable” cases, it would be…
Do pre-existing conditions impact my personal injury claim? How can I prove that my pre-existing injury was worsened by my accident? If you have been the victim of a motor vehicle accident and intend to present a claim for your injuries, any pre-existing medical conditions you have will always be a factor.  The insurance company and its attorneys will want to prove that most or all of the problems you are claiming from the accident…
You have been involved in a motor vehicle accident or some other injury incident.  You intend to make a claim for your injuries and now you have to deal with the insurance adjuster for the at-fault party. How do you handle this? Answer:  Be very careful. Insurance adjusters are in the business of getting information. They then will use this information against you, to try to deny your claim, or to pay you as little…
My personal injury claim feels like it’s taking too long to resolve. What’s the normal time frame for an injury case to resolve?   Every case is different.  Cases are different because every accident is different, every injury is different, every insurance adjuster is different and every insurance company’s policies are different. There is no bright-line rule on how cases are adjusted and evaluated.   Our experienced Phoenix personal injury attorneys will advise you as to…
