Trial Begins in Stop and Frisk Class Action

Today is day one of the bench trial in the class action challenging the NYPD’s use of stop-and-frisk.  Judge Scheindlin certified the class in May of last year.  Earlier this month, the plaintiffs indicated that instead of seeking damages, they intend to seek permanent citywide injunctive relief that would not only enjoin certain police stops and modify certain department policies and procedures, but would also appoint a court monitor and put in place a “Joint-Remedial Process” by which the parties would develop a set of additional agreed-upon remedial measures.  In their joint pre-trial order, the parties estimate that the trial should last over a month.  The AP reports on this morning’s proceedings here.
