Hogan Lovells Publishes Government Contracts Alert on Fair Pay and Safe Workplaces Proposed Rule and Guidance

On July 8, 2015, Hogan Lovells issued a Government Contracts Client Alert on the Obama Administration’s Proposed Rule and Guidance that would amend the Federal Acquisition Regulation (FAR) to implement Executive Order 13673, the “Fair Pay and Safe Workplaces” Executive Order.  Among other things, the proposed rule would require contracting officers to consider a contractor’s reported labor law violations when determining whether the contractor is presently responsible to receive federal contracts.  Additionaly, the proposed rule would require contractors with contracts over $500,000 to report to the Government violations of 17 enumerated labor laws, as well as equivalent state laws, and the violations of subcontractors with subcontracts valued over $500,000.  Our Alert provides detailed guidance on how contractors can prepare now to implement requirements when they are issued in a final rule and become effective.
