The UK Government has made clear that it intends to end the jurisdiction of the Court of Justice of the EU (“CJEU“) in the UK post-Brexit. This will, unless agreed otherwise in the negotiations, result in litigants losing the ability to make references to the CJEU on questions of EU law. In the meantime, the lack of clarity from the UK Government about the extent of the CJEU’s jurisdiction post-Brexit also gives rise to legal uncertainty for citizens and businesses in the UK whose legal proceedings will be outstanding during the Brexit negotiation period, which the courts are beginning to have to grapple with.
