As you are already aware, the Order commencing Schedule 3 of the Flood and Water Management Act 2010 for Wales was made on 1 May 2018. In order to provide sufficient time for Welsh local authorities to establish the SAB approval mechanism and to allow developers time to become aware of the changes and prepare for mandatory SuDS Standards and the requirement for SAB approval before beginning construction an implementation was set on 7 January 2019.

Legislation making sustainable drainage systems (Sud’s) on new developments mandatory is now in effect, all new developments of more than 1 dwelling house or where the construction area is 100m2 or more, will require Sustainable Drainage Systems (SuDS) for surface water.

The Law Society have notified us that they are reviewing the CON29 Guidance Notes, so if you haven’t already reviewed your CON29 enquiry 3.3. reporting arrangements now might be a good time to do so!
