MSHA, Humpty Dumpty, and the Zombie Apocalypse

What does a legal column have to do with Humpty Dumpty or the zombie apocalypse? The answer lies in the Supreme Court’s Kisor v. Wilkie decision, which could change the way courts (including the Federal Mine Safety and Health Review Commission) decide what regulations really mean.

The case was about whether and how courts defer to an agency’s interpretation of its own regulations. What will it mean for MSHA’s authority and future challenges to MSHA citations? In a recent column in Rock Products magazine, we walk through the recent decision and how it may impact MSHA (plus what it’s got to do with zombies and Humpty Dumpty).
