USCIS announced today a phased-in resumption of premium processing. The resumption will occur as follows:

  1. On June 1st, all I-140 petitions can be accompanied by a premium processing request.
  2. On June 8th, H-1Bs filed before June 8th that are pending and are cap-exempt (such as those filed by cap-exempt employers or where a beneficiary was previously counted against the H-1B cap) AND I-129 petitions for non-H-1B cases filed before June 8th that are pending adjudication
  3. On June 15th, premium processing resumes for newly filed H-1B petitions accompanied by an I-907 form where the employer is a cap-exempt  entity or newly filed H-1B petitions for Conrad-30/IGA waivers
  4. On June 22nd, premium processing resumes for all H-1B cap-subject cases for both those filed with an I-907 and for upgrades AND all other Form I-129s eligible for premium processing by filing an I-907 concurrently with an I-129.
