On May 17, 2021, the Court handed down a decision that will allow the federal circuit courts to review a wider array of issues in remand orders. In BP P.L.C.. et al. v. Mayor and City Council of Baltimore, 539 U.S. __ (2021), the Court held that, under 28 U.S.C. § 1447(d), appellate courts may review all the reasons a defendant removed a matter to the federal district court as long as one of those reasons falls under the federal officer or civil rights jurisdiction statutes, codified as 28 U.S.C. § 1442 and § 1443.[1]
