If you are a foreign national planning to travel internationally, recent updates from the American Immigration Lawyers Association (AILA) highlight several risks that you should be aware of before leaving the United States. Based on the latest reports, here’s what you need to know:

never miss an update

Advance Parole Holders with Past Unlawful Presence

If you were granted Advance Parole but had prior unlawful presence in the U.S., traveling internationally may be risky. Current guidance from Customs and Border Protection (CBP) is unclear, and leaving the country could lead to complications upon reentry. We strongly recommend waiting for updated CBP guidance before making any travel plans.

Colombian Nationals Facing Increased Border Screenings

Colombian nationals should expect heightened scrutiny at U.S. borders, particularly if they currently have or previously held a diplomatic visa. Even if you are entering under a different status, enhanced screenings are in place until further CBP guidance is issued.

Uniting for Ukraine Program Suspended

The Uniting for Ukraine program has been halted, and final decisions on pending cases have been suspended. As of January 27, 2025, this change has been reflected on the U.S. Citizenship and Immigration Services (USCIS) website. We will continue to monitor this situation and provide updates as they become available.

Individuals with a Notice to Appear (NTA) Should Avoid Travel

If you have received a Notice to Appear (NTA) in immigration court, traveling internationally is highly discouraged. For example, if you are a lawful permanent resident with an I-551 stamp but have a pending immigration court case due to a denied I-751 petition, travel may be too risky. Until CBP issues further clarification, we advise against leaving the country unless absolutely necessary.

Consult an Immigration Attorney Before Traveling

Given these recent updates, we strongly recommend consulting an immigration attorney before making any travel decisions. The risks associated with international travel vary based on individual circumstances, and professional legal guidance can help you make an informed decision.

We will continue to monitor any changes and provide updates as new guidance is issued. Stay informed and stay safe.
