Kimberly West-Faulcon (Loyola Law School Los Angeles; University of California, Berkeley – Berkeley Center on Comparative Equality & Anti-Discrimination Law) has posted Introducing “Caste” Centric Terminology as Brown Turns Seventy (64 Washburn Law Journal 151 (2025)) on SSRN. Here is the abstract:

Now that the historic Brown v. Board of Education case has turned seventy, it is high time to describe it as a racial caste law. The legal academy should retire the now-anachronistic term “Jim Crow” and the euphemistic term “segregation” and describe Brown v. Board of Education by centering the terms “racial caste” and “whites-only.” It is also important, on Brown’s seventieth anniversary, that whites-only student assignment laws, like the Kansas statute overruled in Brown, be understood to advance the degradation of African Americans as much as their segregation.
