Bipartisan AG Group Opposes Federal KIDS Act for Curtailing Authority

On May 26, 2026, a bipartisan coalition of 44 attorneys general (AGs) issued a letter opposing the federal Kids Internet and Digital Safety Act (KIDS Act), H.R. 7757. The AGs assert that the KIDS Act would preempt their ability to enforce child online safety laws at the state level.

Among other provisions, the KIDS Act mandates that tech platforms disable targeted, addictive algorithmic feeds for minors by default and requires platforms to actively prevent online harms, including cyberbullying, sexual exploitation, and content that promotes self-harm. It additionally requires that platforms deploy both age verification measures to prevent minors from accessing “mature content” and tools for parents to monitor minors’ usage of apps.

The AGs note the act’s broad scope, which covers obscene content, social media, messaging, gaming platforms, and artificial intelligence chatbots. They argue that states serve as “laboratories of democracy” and must remain involved in such regulation due to the speed of technological progress and Congress’s limited progress in enacting related federal legislation.

The letter also objects to the act’s absence of duty of care standards and age assurance obligations for tech platforms, and notes that it permits federal intervention in all cases brought by AGs. However, the AGs express support for parallel federal legislation, the Senate Kids Online Safety Act, S. 1748, which preserves state authority to implement and enforce child-safety laws and imposes a “meaningful” duty of care.

The AGs also argue the act may broadly interfere with state-level progress on many tech issues, given the AG’s now prominent role as online child-safety policymakers. AGs have used consumer protection statutes to investigate and sue social media and technology platforms under theories of deceptive or unfair trade practices and have secured settlements requiring monetary damages and injunctive relief. The injunctive provisions typically require the platforms to implement child-safety procedures — such as age verification, content filters, parental controls, or law enforcement cooperation — above and beyond statutory minimums.

This letter continues a trend of bipartisan AG opposition to federal legislation that threatens their traditional consumer protection and enforcement powers, particularly in the tech sphere. Last year, several dozen AGs opposed, in a bipartisan effort, three federal attempts to preempt enforcement of state artificial intelligence laws. It also demonstrates a continuing focus among AGs on child safety as a strategy for regulating technology platforms.

If passed, the KIDS Act will likely shift the dynamics of child safety regulation involving tech platforms and give federal authorities final say in such enforcement matters. This is significant, particularly within the Trump administration, which has emphasized deregulation and technology innovation. Notably, the legislation would provide a measure of compliance consistency for tech companies hosting such platforms yet would simultaneously curtail the AGs ability to craft creative solutions to address child safety concerns.

The 44 AGs who signed the letter, include those from Alabama, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, the District of Columbia, Georgia, Hawaii, Illinois, Kansas, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, the Northern Mariana Islands, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming. Two state AGs who are notably missing are Florida and Texas, which have aggressively enforced their states’ recently enacted social media laws.
