Commission Implementing Regulation on standalone suspension of DTO under MiFIR

On 15 June 2026, there was published in the Official Journal of the EU (OJ), Commission Implementing Regulation (EU) 2026/1288 of 12 June 2026 on the stand-alone suspension of the trading obligation for derivatives in accordance with the Markets in Financial Instruments Regulation (MiFIR).

The Implementing Regulation is made under Article 32a(1) of MiFIR. It suspends the derivatives trading obligation (DTO) under Article 32a(1)(a) of MiFIR for those entities set out in it with respect to derivatives on UK trading venues. It also suspends under Article 32a(1)(b) of MiFIR the DTO for those entities set out in it with respect to credit default swaps on UK trading venues. The effect is that the firms will be permitted to execute derivatives within the scope of the DTO on UK trading venues.

Next steps

The Implementing Regulation enters into force three days after its publication in the OJ (18 June 2026). The European Commission will review whether the grounds for the suspension of the derivative trading obligation continue to apply every five years from 18 June 2026.
