Statistics for May 2026 consumer litigation filings are in, and the picture is essentially the reverse of April. After all three major consumer protection statutes posted month-over-month increases in April, the first time that had happened in over a year, all three declined in May.
According to a report by WebRecon, court filings under the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), and Telephone Consumer Protection Act (TCPA) all fell in May compared to April, while Consumer Financial Protection Bureau (CFPB) complaint volume, which had dipped in April, moved modestly higher.
WebRecon reports the overall statistics for consumer litigation in May as follows:
- 894 FCRA cases were filed, representing an 8.2% decrease from April;
- 407 FDCPA cases were filed, representing a 9.8% decrease from April;
- 270 TCPA cases were filed, representing an 18.2% decrease from April; and
- 27,319 complaints were filed with the CFPB, representing a 1.1% increase from April.
Despite the month-over-month declines, the longer-term trends remain significant. Compared to the same period in the prior year (January 1 to May 31, 2025), all four categories are up substantially year-to-date: FCRA +42.8%, TCPA +29.6%, FDCPA +14.7%, and CFPB complaints +34.8%.
