EBA consults on first four mandates under the DGSD3

On 23 July 2026, the European Banking Authority (EBA) issued four consultation papers on technical standards and guidelines under the revised Deposit Guarantee Schemes Directive (DGSD3). Under DGSD3, the EBA is mandated to develop 12 technical standards and guidelines, the first four of which have now been published for consultation.

Consultations

The four consultation papers cover draft:

  • Implementing technical standards (ITS) on depositor information per the mandate given to the EBA under Article 16 of the DGSD3. These draft ITS set out harmonised content and formats for depositor information sheets provided at account opening, and on a regular basis. They also establish requirements for communications to depositors in specific situations, such as bank mergers, or failures.
  • ITS on information exchange per the mandate given to the EBA under Article 16a of the DGSD3. These draft ITS introduce standardised procedures, templates and minimum requirements for information exchange in bank failure scenarios. They also enhance reporting from DGSs to the EBA on covered deposits and available financial means and improve transparency on the use of DGS funds.
  • Regulatory technical standards (RTS) on client funds per the mandate given to the EBA under Article 8b of the DGSD3. The draft RTS establish rules to ensure that DGSs receive the data needed to identify and reimburse clients whose funds are held in intermediary accounts. They also clarify when reimbursement should be made directly to clients or via the account holder and how to prevent duplicate payouts.
  • Guidelines on investment of available financial means per the mandate given to the EBA under Article 10(13) of the DGSD3. The draft guidelines set out how DGSs should invest their funds to ensure diversification, low risk and sufficient liquidity.

Next steps

The deadline for comments on each consultation paper is 23 October 2026.

A public hearing will take place on 24 September from 10:00 to 13:00 CEST. The deadline for registration is the 21 September 2026, 12:00 CEST. 

The draft RTS will be submitted to the European Commission for endorsement following which they will be subject to scrutiny by the European Parliament and the Council before being published in the Official Journal of the European Union. It is planned for the EBA to submit the draft RTS in Q4 2026.
