O v N [2026] SADC 88 (Link to JADE).
O claimed damages for trespass to the person and negligence in relation to abuse by N (her uncle), between 1978 and 1985. N had admitted the sexual abuse and sexualised conduct in the criminal jurisdiction of this Court. A defence was not filed to the civil claim and the respondent did not give evidence at the trial.
Damages were assessed as follows:
- Past non-economic/non-pecuniary loss: $215,000
- Future non-economic/non-pecuniary loss: $150,000
- Aggravated Damages: $36,500
- Interest on past non-economic/non-pecuniary loss: $112,500
Total $514,000
