Update: ChatGPT Returns To Italy

Provisional political agreement on AI ACT

On April 27th, 2023, a provisional political agreement was reached on the world’s first regulation on Artificial Intelligence. Among the key points are:

  • Stricter obligations for basic models, which include ChatGpt;
  • Design of generative AI systems in compliance with EU law and fundamental rights, including freedom of expression;
  • Understanding of high-risk AI systems that can cause harm to health, safety, or fundamental rights, and recommendation systems of large online platforms, as defined by the Digital Services Act – Regulation (EU) 2022/2065;

Increased measures to protect sensitive data, limiting the actions of high-risk system providers in processing collected information to avoid prejudice in AI operations.

The text of the AI Act may still be subject to some technical adjustments, but it is reasonable to expect that the plenary vote will take place in mid-June.

Chat GPT available in Italy again

Great news! As of April 30th, 2023, ChatGPT (Model 3.5) is now accessible in Italy again. To comply with European data protection regulations, OpenAI has taken important steps, including providing clear information on how personal data is used for algorithm training and offering users the right to object to this use. Additionally, a welcome screen has been introduced with links to the updated privacy policy and data processing methods. OpenAI has also implemented measures to ensure minors have parental consent and created a form for European users to exercise their right to object to the processing of their personal data.

The Italian Garante acknowledges the steps taken by OpenAI to reconcile technological progress with respect for people’s rights and hopes that the company will continue on this path of compliance with European data protection regulations. The Authority will continue its investigative activities against OpenAI and will work with the relevant task force established within the Committee that brings together the privacy authorities of the European Union.
