David Kolhoff has practiced law since 1986, focusing exclusively on employ benefits law since 1990. His practice focuses on all aspects of tax, labor, insurance and securities law applicable to pension benefit and welfare benefit employer sponsored plans. Most recently he has focused on pension benefit plans governed by Sections 403(b), 401(k) and 457 of the Internal Revenue Code, including the design, administration and the correction of inevitable errors related to such plans. He has particularly strong understanding of the intersection of the tax, labor, insurance and securities law with respect to such plans and was very instrumental in developing one of the first open architecture investment/administration products available to these plans.

David was a senior counsel at Lincoln Financial Group for 14 years, leading the group of attorneys providing support to its defined contribution business for several years shortly before his semi-retirement from Lincoln. He spent 12 years as a senior attorney at FedEx, the sole ERISA attorney there for several years before moving back to the Midwest for family reasons and the job at Lincoln. Since his retirement from Lincoln mid-2011, David has developed a solo law practice with emphasis on legal issues affecting employee benefit plans.

David has been active in various employee benefits organizations, including serving as president and on the board of the local ASPPA affiliate in northeast Indiana, on the pension committee of the Investment Company Institute and as chair of the American Council of Life Insurers task force on 403(b) regulations. He has spoken widely at conferences and provided internal training at FedEx and Lincoln, including training for Lincoln’s plan sponsor customers. He graduated with honors from the University of Akron School of law in 1986 and Kent State University in 1974.
