NSBA Responds to OCR “Dear Colleague” Letter Regarding Bullying Investigations

The National School Boards Association (“NSBA”) recently responded to the “Dear Colleague” letter concerning bullying investigations issued by the Office of Civil Rights (‘OCR”) in October of this year. In its response, the NSBA contends that, through its letter, OCR interprets the law concerning complaints of harassment significantly broader than intended by the United States Supreme Court. According to the NSBA, OCR’s letter will lead to “misguided litigation” against boards of education. Click here to read the full text of the NSBA’s response.
