Continue to Use the Current Form I-9 for Employment Eligibility Verification

US Citizenship and Immigration Services (USCIS) announced that employers should continue using the Form I-9 currently available on their website.  This form should continue to be used even after the OMB control number expiration date of August 31, 2012 has passed.   The expiration date can be found in the upper right hand corner of the form.

Practice Pointer — Employers must complete a Form I-9 for all newly-hired employees to verify their identity and authorization to work in the United States.  Employers must retain the Form I-9 for the duration of an employee’s employment with the company.  Once an employee is terminated or otherwise leaves the company, an employer may purge the Form I-9 following a set formula.  The formula is three years after the date of hire OR one year after termination, whichever is later.  When purging the Form I-9 always take care to properly purge the form either by shredding it or placing it in a burn bag — never discard of the form by throwing it in the trash as it contains confidential personally identifiable information.

Stay tuned to this blog for news of any changes or updates to this information as employers are responsible for using the most current version of the Form I-9.
