Following a nine day trial, last Friday a Boston jury delivered a patent infringement verdict in favor of Veracode, Inc. and Rovi Solutions Corporation. In the case before Judge Woodlock in the U.S. District Court for the District of Massachusetts, Veracode and Rovi accused Appthority, Inc. of infringing two patents. The two asserted patents, U.S. Patent Nos. 5,854,924, titled “Static Debugging Tool and Method,” and 7,752,609, titled “Software Analysis Framework,” relate generally to means and methods for scanning and debugging computer and mobile application software to address security vulnerabilities and prevent malware attacks. Veracode and Rovi initiated the lawsuit in March 2012.
The jury found that Appthority’s cloud-based analysis engine, the Appthority Platform™, infringes asserted claims 1 and 5 of the ’924 patent. The jury further determined that Appthority’s infringement was willful. (Appthority was found not to infringe claim 17 of the ’924 patent and all asserted claims of the ’609 patent.) The parties subsequently submitted Joint Proposed Damages Jury Instructions, and this week the jury awarded $781,857 in damages.
