Canada Debates Mandating Plaintiffs Attorneys to Inform Clients About ATE Insurance

Thanks the prohibitive cost of litigation, after-the-event (ATE) insurance is growing in popularity in Canada. Such insurance protects plaintiffs from having to pay a full cost award if they lose their case. In the UK, attorneys are compelled to let their clients know such insurance exists, and what their options are for purchasing it, otherwise they risk running afoul of negligence laws. Canada is considering following suit, and compelling attorneys to educate their clients about ATE insurance.
