Irish Supreme Court Urges Politicians to Address Rising Litigation Costs

“The cost of litigation is forever increasing beyond the means of more and more people,” said Chief Justice Frank Clarke of the Irish Supreme Court. Ireland is one of the only jurisdictions to outlaw third party litigation funding on the basis that it violates age-old doctrines of champerty and maintenance. But that could soon change, as Irish Courts are compelling politicians to address prohibitive litigation costs that keep rising every year, warning lawmakers that if significant changes aren’t made, then courts may take action themselves.
