How Will COVID-19 Affect My Injury Case?

While there can be no doubt that we are currently living in challenging and unprecedented times due to the COVID-19 outbreak, the attorneys and staff at Stark & Stark are still working hard to obtain justice for injured victims. We are proud to say that we remain open for business with all attorneys and staff working from home, and in compliance with social distancing guidelines. That being said, the COVID-19 outbreak presents some unique challenges that must be addressed when pursuing a personal injury case.

First, and probably most importantly, the current restrictions are making it more difficult than ever to obtain non-emergent medical treatment, including physical therapy and orthopedic care. In spite of this, it remains vitally important for all injury victims to obtain some form of care if we are to obtain fair compensation on their behalf. One alternative to traditional medical care is telemedicine, which can be accomplished over the phone or, ideally, with the use of a videoconferencing software such as Zoom. This approach allows a medical professional to document injuries and symptoms while offering basic treatment such as home exercises which may help to manage symptoms temporarily. At Stark & Stark, we are working directly with every client to be sure that their medical treatment needs are met, even in this challenging time.

Another way in which injury cases are being impacted by the COVID-19 outbreak is indefinite delays due to court closures. While there is not much that we can do to change this, it is very important to make sure that both new and existing clients understand that these delays are inevitable. This allows us to take full advantage of all court services that remain available, such as e-filing. We also continue to conduct discovery and depositions through the use of videoconferencing software.
