An area of litigation and arbitration that has become increasingly associated with funded claims is the world of international investment treaties, and claims brought by corporations against governments for being in breach of these treaties. The latest occurrence of such a dispute has seen an arbitral panel order the Tanzanian government to pay over $109 million to an Australian mining company, for the government’s breach of a bilateral investment treaty.
