Abuse: Contacting persons named in unredacted documents.

Mansour v The Trustees for the Roman Catholic Church for the Diocese of Parramatta [2026] NSWSC 186 (Link to Caselaw).

The defendant having provided certain unredacted documents, the plaintiff sought orders enabling the solicitors for the plaintiff to contact identified persons for the purposes of ascertaining their willingness to provide statements or other information relevant to the plaintiff’s claim.

Orders were made by the court in relation to some of the identified persons as follows:

  1. Grant leave to the solicitor for the plaintiff to contact the persons identified in the Schedule to Notice of Motion filed by the plaintiff on 2 March 2026, except for those persons identified at paragraph (c) and (g), for the purpose of ascertaining those persons availability and willingness to provide statements or information relevant to the plaintiff’s claim.
  2. As a condition of that leave, direct that any contact with those persons be made by Mr Jonathan O’Riordan only, and no-one else.
  3. Further direct that when contact is made to the persons identified in the Schedule to the motion, that it is made plain to those persons that although leave has been granted by the Court, it does not obligate them in any way to speak to or communicate with the solicitor for plaintiff.
