Ordinance on Notifications and the Submission of Documents under the Crypto Markets Supervision Act published in the Federal Gazette

On 26 May 2026, the Ordinance on Notifications and the Submission of Documents under the Crypto Markets Supervision Act (Verordnung über die Anzeigen und die Vorlage von Unterlagen nach dem Kryptomärkteaufsichtsgesetz – KMAnzV), issued by the Federal Financial Supervisory Authority (BaFin) on 20 May 2026, was published in the German Federal Gazette.

The KMAnzV elaborates and specifies the notification and document submission obligations incumbent upon crypto-asset service providers (CASPs) and other regulated entities under Germany’s Crypto Markets Supervision Act (KMAG). The KMAG, in turn, implements and supplements the EU Markets in Crypto-Assets Regulation (MiCAR) (Regulation (EU) 2023/1114) at national level.

The ordinance is closely modelled on established notification regimes under the German Banking Act (Kreditwesengesetz – KWG) and the Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz – ZAG). It introduces standardised notification forms and procedures, with a view to enhancing consistency and transparency, while providing regulated entities with greater clarity regarding administrative expectations.

Submissions may be made in English. However, BaFin reserves the right to request a German translation, in which case the German-language version shall be legally authoritative.

Of particular note are the extensive notification requirements relating to material outsourcing arrangements (wesentliche Auslagerungen), including notifications concerning both the intended outsourcing and its implementation and ongoing management.

Firms operating in, or providing services into, the German crypto-assets market should promptly review and, where necessary, adapt their internal notification processes and compliance frameworks to ensure alignment with the requirements introduced by the KMAnzV.
