Medical: ECT treatment of an involuntary patient (appeal).

KLH v Northern NSW Local Health District [2026] NSWSC 590 (Link to Caselaw)

These proceedings constituted an appeal under section 163 of the Mental Health Act 2007 NSW from a determination made on 30 March 2026 by the Mental Health Review Tribunal , granting an application by an authorised medical officer of a “mental health facility” for an “ECT administration inquiry” leading to an “ECT determination” allowing electroconvulsive therapy (“ECT”) treatment of an adult person (“JTR”, aged 28 years), an “involuntary patient” at the mental health facility known as the Tallowwood Mental Health Inpatient Psychiatric Unit.

Ultimately the court was satisfied that JTR’s mental health facility is justified in proceeding on the basis (subject to ongoing review by the his treating doctors in consultation with JTR and his mother KLH) that the potential benefits of ECT treatment outweigh the known risks of such treatment and that it is in JTR’s best interests that the present, proposed regime of ECT treatment be approved.
