The plaintiff was sexually assaulted after her year 12 school formal. The relevant defendant here (the third defendant) was the brother of the first defendant who was on remand following his arrest for the sexual assaults. The second defendant was also arrested and convicted.
The first defendant conspired with his brother, the third defendant, to locate the plaintiff and coerce her to change her evidence to falsely assert she had consented to the sexual activity.
The first and third defendants were later convicted of attempting to pervert the course of justice. In this matter the plaintiff established that the first and third defendants conspired to injure her by causing her psychological harm and that she suffered psychological injuries and economic loss.
Damages were assessed, with slight variations, against the first, second and third defendants. Judgment against the third defendant was for about $530,000.
