Beginning as early as January 15, 2023, certain employers will need to ensure they are complying with the District of Columbia’s Transportation Benefits Equity Amendment Act of 2020, also known as the “Parking Cash Out Law.”

She is a seasoned litigator, having represented employers ranging in size from eight to 18,000 employees in litigation, and administrative proceedings. She helps clients on a daily basis to comply with state and federal employment laws and navigate challenging workplace law issues. She provides practical business advice based on “best practices” and is a sought-after speaker and trainer on employment law topics.

Teresa was the litigation manager of the Washington, D.C. Region office of Jackson Lewis from 2005 until 2014. As the litigation manager, she served as the office’s local expert on litigation questions, monitored litigation trends, educated the D.C. office attorneys on developments in workplace litigation, and assigned and tracked litigation within the office, while managing her own caseload.

Teresa also is active in the firm’s Disability, Leave and Health Management practice group. In that capacity, Teresa acts as a regional and national expert on employee health and leave issues facing employers, including issues arising under the Family and Medical Leave Act, the Americans with Disabilities Act, the Genetic Information Nondiscrimination Act, and similar state and local laws, such as the D.C. Sick and Safe Leave Act and Maryland Healthy Working Families Act.

Teresa counsels employers daily regarding such employment issues as employee discipline and termination; discrimination and harassment; preparation of employment contracts; drafting personnel policies and handbooks; and investigation of employee misconduct. She is an expert on issues arising under the Americans with Disabilities Act, the Family and Medical Leave Act and similar state and local laws, and is part of her firm’s task force on independent contractor misclassification.

Her goal with every client is to provide practical and straightforward advice that breaks down and makes accessible the myriad issues and considerations arising under ERISA, the Internal Revenue Code (including Sections 280G, 401(k), 403(b), 409A and 457(b) and (f)), the Affordable Care Act, COBRA, HIPAA, and the various other federal and state laws and regulations affecting benefit plans.

As part of her day to day advice and counsel work, Kellie regularly reviews, drafts and amends self- and fully-insured health and welfare plans; cafeteria plans; qualified and non-qualified retirement plans; employment, consulting, severance and change in control agreements; and stock option and other equity-based compensation plans. She drafts and prepares submissions under the Internal Revenue Service’s Employee Plans Compliance Resolution System and the Department of Labor’s Voluntary Fiduciary Correction Program, and reviews and qualifies proposed Qualified Domestic Relations Orders and Qualified Medical Child Support Orders. Kellie also counsels on corporate governance and fiduciary matters, including the structure and duties of retirement and benefit plan committees.

Kellie also has extensive experience advising on all benefits-related aspects of corporate transactions, from due diligence and transaction document negotiations to benefits integration following a closing. She particularly enjoys building relationships during the transaction process that continue after the deal is done.

Bria M. Cochran is an associate in the Washington, D.C. Region office of Jackson Lewis P.C. Her practice focuses on representing employers in workplace law matters, including preventive advice and counseling and diversity and inclusion matters.

Bria has experience litigating in federal court, state court and before administrative agencies, while also appearing regularly at arbitrations and mediations. She has successfully handled cases involving claims of race, age, disability, and sex discrimination, as well as breach of contract, sexual harassment, retaliatory discharge, and wage-hour claims.

Along with her strong litigation experience, Bria also conducts sensitive workplace investigations. For example, Bria investigated allegations that the Chair of a Board of Directors was harassing the CEO of an organization.

Bria advises organizations in their efforts to foster diversity, equity, and inclusion. She is often called upon by clients to help them avoid or mitigate the expense of litigation by conducting corporate diversity assessments and training seminars on employment and diversity-related issues. She also assists companies with developing and implementing comprehensive diversity enhancement plans.
