作者：王峰、戴梦皓 联系人：Aaron Wolfson 金杜律师事务所 2020年4月28日，美国商务部产业安全局（Bureaus of Industry and Security, 下称“BIS”）在《联邦纪事》上发布了三则公告[1]，对《出口管理条例》（Export Administration Regulation, 下称“EAR”）中多个条款进行了大规模修订或提出拟议规则，拟取消多项许可例外并对特定出口限制大幅收紧。作为近年来EAR较大规模的修改之一，本次修改的指向性非常明显。我们对美国出口管制政策多年的经验和思考，特准备此文，就本次修订对中国企业可能造成的影响进行说明，希望中国企业能对此有清晰的理解，并对企业发展做出正确的判断。 一、EAR具体修改情况说明 本次EAR修改共提出两项正式修改规则和一项拟议规则，两项正式修改规则均在2020年6月29日正式生效，而拟议规则也将在2020年6月29日结束意见征集。两项正式修改规则中，一项为废止EAR740.5节所设置的许可例外“民用最终用户”（Civil End User, 下称“CIV”）；一项则为修订EAR744.21节，加强了对华军事最终用途和最终用户的出口限制。而拟议规则计划对EAR740.16节所指的许可例外“额外许可再出口”（Additional Permissive Reexports，下称“APR”）的适用情况进行修正。以上两项正式修改规则和拟议规则的具体内容主要包括以下方面： CIV许可例外取消 根据现行EAR 740.5(a)节的规定，如果列于《商业管控目录》（Commercial Control List, 下称“CCL”）的物项基于民用最终用户用于民用最终用途之目的，向除朝鲜以外的D：1组国家（包括中国）相关实体提供时，若该等物项比对《商业国家管控表》（Commercial Country Chart，下称“CCC”）的受控原因仅为国家安全（National Security，下称“NS” ），且对应的出口管制分类编码（Export Control…
