进入21世纪，随着互联网的飞速发展，电商购物、在线支付、数字内容、物联网等新型服务形式逐渐走入人们的生活，互联网联通不同国家的“无边界”特质也使电子商务和数字贸易成为跨境贸易的重要部分。然而，在国际规则层面，世界贸易组织（“WTO”）现有的多边贸易体系并未为新兴的电子商务贸易形式提供规则框架。为了弥补这一空白，2017年12月，71个WTO成员方在阿根廷布宜诺斯艾利斯召开的第十一届部长级会议上共同发布《关于电子商务的联合声明》（以下简称《联合声明》），宣布就电子商务议题的谈判开启探索性工作。2020年12月7日，《联合声明》全体成员方内部散发了电子商务谈判现阶段形成的合并案文，[1]并于12月18日共同发表通告，宣布电子商务谈判取得重大进展，将在2021年召开的第十二届部长级会议上报告实质性成果。
