《生态环境法典》系列解读——“一典一释”格局下企业环保刑事风险研判（一）

作者：潘东 李冰 王甜甜 2026年上半年，我国生态环境刑事法律体系迎来了历史性的重大变革。《中华人民共和国生态环境法典》于2026年3月12日经第十四届全国人民代表大会第四次会议表决通过，将于2026年8月15日起施行；与此同时，《最高人民法院、最高人民检察院关于修改〈关于办理环境污染刑事案件适用法律若干问题的解释〉的决定》（法释〔2026〕4号）于2026年3月30日起施行。这两部法律文件的并行出台，构成了我国生态环境刑事法律体系“一典一释”协同发力的制度格局。 阅读更多

污染环境犯罪刑事辩护方法论与实务路径

作者：吴青 潘东 自《刑法修正案（八）》将“重大环境污染事故罪”修改为“污染环境罪”以来，两高先后于2013年、2016年、2023年出台三部司法解释，并于2026年3月对2023年解释作出修正（法释〔2026〕4号），整体趋势是先扩张、后精简但入罪门槛持续降低、适用范围实质扩大。“严重污染环境”的认定情形从2013年的14项、2016年18项，调整为2023年至今的11项（合并同类情形、标准更集中严格），“有毒物质”的范围不断拓宽，过去仅构成行政违法的行为，如今越来越多出现多种法律责任竞合的情形，除行政责任外，还可能被追究刑事责任，以及被要求承担生态环境损害赔偿。矿产资源开发、金属冶炼、化工、危废处置等环境敏感行业，正面临前所未有的刑事合规压力。 阅读更多
