半导体产业出口管制风波又起——美国1202新规锐评及136家清单企业分类解析

作者：刘新宇 郭欢 陈起超 董梦 刘学朋 王丹 陈琳 2024年12月2日，美国商务部工业与安全局（BIS）针对中国半导体行业发布了两项重要的出口管制新规，即《补充外国直接生产规则以及修订先进计算和半导体制造物项管制措施》（简称“《暂行最终规则》”）和《实体清单的新增和修改及移出经验证最终用户》（简称“《最终规则》”）。《暂行最终规则》进一步加强了对中国芯片产品及其生产能力的出口管制，特别是聚焦于先进计算、超级计算及半导体制造领域的关键技术和设备。而《最终规则》将大量中国半导体行业实体加入到实体清单之中，其中新增了 140 个半导体行业实体，含136家中国企业，并修改了清单上 14 个现有条目，对特定中国企业增注了实体清单脚注5。 阅读更多

作者：郭欢 陈起超 董梦 王丹 2024年10月19日，中国国务院正式对外发布《中华人民共和国两用物项出口管制条例》（下称“两用物项条例”），该条例将于2024年12月1日起正式实施。《两用物项条例》的上位法是《中华人民共和国出口管制法》，《两用物项条例》的推出进一步完善了中国出口管制法律体系，也标志着中国在规范两用物项管理，构建中国出口管制法律组合拳方面迈出了重要一步。具体而言，《两用物项条例》更加详细、完善地从管制物项的范围、适用的管制行为、两用物项管制具体措施、市场主体的权利与法定义务以及相关法律责任等方面进行了规范，共6章50条，提出了中国对两用物项监管的总体要求、介绍了中国两用物项出口管制的管理体制，明确了许可等便利化措施。 阅读更多
