作者：景云峰 李慧斌 自2020年10月17日《中华人民共和国出口管制法》颁布并于同年12月1日正式实施以来，中国两用物项出口管制体系进入全面系统化建设阶段。商务部、海关总署等部门依据该法，陆续出台针对无人机、石墨、高压水炮、稀土等关键物项的出口管制公告，开始加速构建以《出口管制法》为核心的中国两用物项出口管制法律体系。2024年，随着《中华人民共和国两用物项出口管制条例》及《中华人民共和国两用物项出口管制清单》的相继颁布和实施，在两用物项出口管制范围、执法程序、法律责任等方面形成更为明确的法律依据。随着中国两用物项出口管制制度的进一步细化和完善，行政处罚与刑事追责的界限日益明晰，监管部门对两用物项出口的执法力度持续加强，中国企业在“走出去”过程中正面临日益严峻的出口管制合规挑战。 阅读更多
