《中华人民共和国增值税法（草案）》条文修改建议

作者：叶永青 王一骁 马晓煜 肖颖 《增值税法》的立法工作早在2019年就已经展开，但由于增值税是我国现行税制下的主体税种，立法牵涉面广，需要考虑的问题多元且复杂，故而历经三年有余，才最终在2022年底进入全国人大常委会审读阶段。我们在2019年底曾参与了《增值税法（征求意见稿）》的专家论证，并先后针对2019年征求意见稿、2020年送审稿等历次版本提出和发表了我们的修改建议。从这次全国人大公开征求意见的《增值税法（草案）》（“《草案》”）来看，立法已经确立了较为稳定、合理的制度框架，并对现行增值税法律制度进行了必要的整合、梳理、优化，且我们此前轮次提出过的个别建议已经反映在了《草案》当中。但不论从体例结构、核心制度体系还是规则细节的角度，《草案》还留有许多值得探讨的理论、实践问题和精益求精的空间。本文整合了针对本轮《草案》的新建议和我们早在2019年已经提出和发表过的、本轮《草案》依然适用的老建议，从条文层面向读者整体性地阐述我们对本次立法的系统化建议。此外，我们对《草案》的要点式评析参见《中华人民共和国增值税法（草案）》的亮点、变化和问题》一文。 阅读更多
