On August 10, 2011, Illinois Governor Pat Quinn signed Senate Bill 2106, which amends the Illinois Electronic Products Recycling and Reuse Act (“the Act”). The new law is aimed at ensuring that more electronic products will be recycled. It is predicted that the new requirements under the law will increase the recycling of electronic devices from 28 million pounds in 2011 to 50 million pounds in 2012. This increase will be accomplished by various means, including the following:
(1) The scope of electronic devices covered by the Act has expanded to cover a wider range of devices, such as video game consoles and electronic keyboards.
(2) The recycling goals for manufacturers has increased. For example, in 2012, manufacturers will be required to recycle 40 percent of products sold in 2010.
(3) The fine for violations of the Act has increased from $1,000 to $7,000 per violation.
